1. Acceptance of Terms
By creating an account, accessing, or using My IT Support Report Card’s platform and services, you agree to comply with and be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.
2. Description of Service
My IT Support Report Card is a software-as-a-service (SaaS) platform that provides tools for business owners to evaluate, monitor, and manage their IT service provider relationships. Our services include:
- 70-Point MSP Assessment Tool
- IT Budget Calculator
- Accountability tracking features
- Educational resources and guides
- Performance monitoring tools
3. User Accounts and Registration
Account Creation
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Account Eligibility
You must be at least 18 years old and have the authority to enter into this agreement on behalf of your business to use our services.
4. Subscription Plans and Payments
Subscription Tiers
We offer three subscription tiers: Essential ($47/month), Professional ($97/month), and Enterprise (custom pricing). Each tier provides different features and access levels as described on our pricing page.
Billing and Payment
By subscribing to a paid plan, you agree to:
- Pay all fees associated with your selected subscription tier
- Provide current, complete, and accurate billing information
- Authorize us to charge your payment method on a recurring basis
- Update your payment information promptly if it changes
Automatic Renewal
Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You will be charged the then-current subscription rate.
Price Changes
We reserve the right to modify subscription prices with 30 days’ notice. Price changes will apply to subsequent billing cycles after the notice period.
Free Trial
Professional plan subscribers receive a 14-day free trial. You will not be charged until the trial period ends. You may cancel anytime during the trial without being charged.
5. Cancellation and Refunds
Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing cycle. You will retain access to paid features until that date.
Refund Policy
We offer a 14-day money-back guarantee. If you’re not satisfied within the first 14 days of your paid subscription, contact us for a full refund. After 14 days, subscription fees are non-refundable.
Account Deletion
Upon cancellation, your account data will be retained for 90 days, after which it will be permanently deleted unless required for legal purposes.
6. User Responsibilities and Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations
- Share your account credentials with others
- Use the service for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service or servers
- Upload malicious code or viruses
- Scrape, copy, or reverse engineer our platform
- Use the service to compete with My IT Support Report Card
- Resell or redistribute our services without authorization
7. Intellectual Property Rights
Our Property
All content, features, and functionality of My IT Support Report Card, including but not limited to text, graphics, logos, software, and assessment methodologies, are owned by My IT Support Report Card and protected by copyright, trademark, and other intellectual property laws.
Your Content
You retain all rights to the data and information you input into our platform. By using our service, you grant us a limited license to use, store, and process your content solely for the purpose of providing our services to you.
Assessment Reports
Reports generated by our platform are for your internal business use only. You may not redistribute, resell, or publicly share assessment reports without our written permission.
8. Disclaimers and Limitations of Liability
Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The service is provided “as is” and “as available” without warranties of any kind, either express or implied.
Educational Purpose
Our assessments and recommendations are for informational and educational purposes only. They do not constitute professional IT consulting, legal, or financial advice. You should consult with appropriate professionals before making business decisions.
Limitation of Liability
To the maximum extent permitted by law, My IT Support Report Card shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless My IT Support Report Card, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the service, your violation of these terms, or your violation of any rights of another party.
10. Termination
We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, for conduct that we believe violates these terms, is harmful to other users, or is otherwise harmful to our business interests. Upon termination, your right to use the service will immediately cease.
11. Modifications to Terms
We may modify these Terms of Service at any time. We will provide notice of material changes by email or through our platform. Your continued use of the service after such notice constitutes acceptance of the modified terms.
12. Governing Law and Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of the State of Louisiana, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
13. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Service shall otherwise remain in full force and effect.
14. Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and My IT Support Report Card regarding your use of the service and supersede all prior agreements.
